James S. Coleman was the major proponent of rational choice theory. This article challenges the traditional reading of his work by showing that under the explicit theory of rational choice lay a latent non-rational theory of action. The article shows that instead of rationality, Coleman's psychological starting point was existential insecurity; that instead of the alleged mechanism of the maximization of utility, actors choose to conform to peer values and norms in order to alleviate insecurity; and that the optimal setting (...) for action is provided by intimate and dense communities, rather than unregulated free markets. These three non-rational presuppositions are analyzed and it is suggested that they are crucial for understanding Coleman's assessment of modernity, social change and his call for the rational reconstruction of society. In 1969 Harry Frankfurt published his hugely influential paper 'Alternate Possibilities and Moral Responsibility' in which he claimed to present a counterexample to the so-called 'Principle of Alternate Possibilities' ('a person is morally responsible for what he has done only if he could have done otherwise'). The success of Frankfurt-style cases as counterexamples to the Principle has been much debated since. I present an objection to these cases that, in questioning their conceptual cogency, undercuts many of those debates. Such cases (...) all require a counterfactual mechanism that could cause an agent to perform an action that he cannot avoid performing. I argue that, given our concept of what it is for someone to act, this requirement is inconsistent. Frankfurt-style alleged counterexamples are cases where an agent is morally responsible for an action he performs even though, the claim goes, he could not have avoided performing that action. However, it has recently been argued, e.g. by John Fischer, that a counterexample to the Principle could be a 'Fischer-style case', i.e. a case where the agent can either perform the action or do nothing else. I argue that, although Fischer-style cases do not share the conceptual flaw common to all Frankfurt-style cases, they also fail as counterexamples to the Principle. This paper presents an analysis of the sorites paradox for collective nouns and gradable adjectives within the framework of classical logic. The paradox is explained by distinguishing between qualitative and quantitative representations. This distinction is formally represented by the use of a different mathematical model for each type of representation. Quantitative representations induce Archimedean models, but qualitative representations induce non-Archimedean models. By using a non-standard model of \ called \, which contains infinite and infinitesimal numbers, the two paradoxes are shown (...) to have distinct structures. The sorites paradox for collective nouns arises from the use of infinite numbers, whereas the sorites paradox for gradable adjectives arises from the use of infinitesimal numbers. Each paradox can be traced to a different source of vagueness. The sorites paradox for collective nouns is caused by \, and the sorites paradox for gradable adjectives is caused by \ \. If correct, this analysis implies that infinite and infinitesimal numbers are cognitively real, and that they play a role in the semantic interpretation of natural language. (shrink)

What kind of thing is a reason for action? What is it to act for a reason? And what is the connection between acting for a reason and rationality? There is controversy about the many issues raised by these questions. In this paper I shall answer the first question with a conception of practical reasons that I call ‘Factualism’, which says that all reasons are facts. I defend this conception against its main rival, Psychologism, which says that practical reasons are (...) mental states or mental facts, and also against a variant of Factualism that says that some practical reasons are facts and others are false beliefs. I argue that the conception of practical reasons defended here provides plausible answers to the second and third questions above; and gives a more unified and satisfactory picture of practical reasons than those offered by its rivals. Rational justification of claims with empirical content calls for empirical and not only normative philosophical investigation. Empirical approaches to bioethics are epistemically valuable, i.e., such methods may be necessary in providing and verifying basic knowledge about cultural values and norms. Our assumptions in moral reasoning can be verified or corrected using these methods. Moral arguments can be initiated or adjudicated by data drawn from empirical investigation. One may argue that individualistic informed consent, for example, is not compatible with the Asian (...) communitarian orientation. But this normative claim uses an empirical assumption that may be contrary to the fact that some Asians do value and argue for informed consent. Is it necessary and factual to neatly characterize some cultures as individualistic and some as communitarian? Empirical investigation can provide a reasonable way to inform such generalizations. In a multi‐cultural context, such as in the Philippines, there is a need to investigate the nature of the local ethos before making any appeal to authenticity. Otherwise we may succumb to the same ethical imperialism we are trying hard to resist. Normative claims that involve empirical premises cannot be reasonably verified or evaluated without utilizing empirical methods along with philosophical reflection. The integration of empirical methods to the standard normative approach to moral reasoning should be reasonably guided by the epistemic demands of claims arising from cross‐cultural discourse in bioethics. Given the restrictions of space (a limitation they too had to contend with), we can only respond to a few aspects of their interesting (...) remarks. We shall reply of course on the basis of our own approach—an approach that sets out to integrate culture, behavior, and experience, and that might be termed contextual phenomenology, phenomenological behaviorism, or perhaps most accurately (albeit more awkwardly), the phenomenological–behavioral perspective.In her commentary, Ibáñez-Guerra (2008), referring to the target articles “Phenomenology and behaviorism” (Pérez-Álvarez, Sass, and Cangas 2008) and “The role of superstition in psychopathology” (García-Montes et al. 2008), wonders whether our maintaining of the spirit of Skinner, as well as our recourse to phenomenology, might not themselves represent forms of superstitious behavior. She points out that it is not always a good idea to put new wine in old barrels. For her, the new wine and new barrels would be represented by social constructivism, of which she is reminded by some aspects of our work. But in making her own case, Ibáñez-Guerra (2008) reveals certain common prejudices concerning behaviorism, prejudices that have apparently persisted even after reading our article. Thus, for example, she does not see operant behavior as incorporating intentionality (what, in the target article, is presented in terms of final causality), because she assumes that intentionality would necessarily imply a mentalist and dualist notion involving a supposed internal mental entity that causes behavior. Skinner (1974) himself noted and rejected this very assumption in a passage that clearly distinguishes his own approach from what he calls a “stimulus-response formula”: “Possibly no charge,” he wrote,is more often leveled against behaviorism or a science of behavior than that it cannot deal with purpose or intention. A stimulus-response formula has no answer, but operant behavior is the very field of purpose and [End Page 281] intention. By its nature it is directed toward the future: a person acts in order that something will happen, and the order is temporal.(pp. 55–6)The place Skinner gives to intentionality and purpose is elaborated in our target article.Furthermore, Ibáñez-Guerra (2008) assumes that, on methodological grounds, Skinner rejects all that is not observable, or at least that cannot be operationalized. This, however, is simply incorrect, at least as regards Skinner’s radical behaviorism. As the reader may recall, radical (as opposed to methodological) behaviorism is neither operationalist nor does it reject private or subjective events because of their unobservability. Indeed, Skinner specifically acknowledges that such events are in fact observable—at least for one person: the subject him- or herself. The question for Skinner is to understand how the part of the world that is only observable and experiential for oneself is constructed or formed. In the end, it turns out that radical behaviorism is more radical, in the Aristotelian ontological sense (see Pérez-Alvarez, Sass, and García-Montes 2008), than post-modern constructionism. Indeed, as we remarked, radical behaviorism can still surprise us today. Similarly, phenomenology is starting to be missed in the clinical context (Andreasen 2007). We believe that radical behaviorism and phenomenology, mutually readjusted, are in fact excellent wines for the times we live in—if only we knew how to appreciate them.In their commentary on “Phenomenology and behaviorism: A mutual readjustment,” Fletcher and Hayes (2008) argue that the philosophy and theory of Acceptance and Commitment Therapy (ACT)/Relational Frame Theory (RFT) already contain the salutary aspects of phenomenology that we highlight in our target article. Their insistence on reducing the affinities we find between phenomenology and behaviorism to ACT/RFT consists, in our view, in a scientific–technical argument that is more scientistic than strictly philosophical in nature. In the mid-1970s, the fascist-leaning dictatorships in Spain (1939–1977) and Portugal (1933–1974) fell. Closely linked to the 1973 oil crisis, debates over energy and technology policies became very prominent during the ensuing political redefinition of both countries. Two decades after the first international agreements between the Iberian regimes and the United States for the development of nuclear programs, a myriad of movements of social resistance to nuclear technology emerged in dialogue with anti-nuclear organizations in other European countries. Fun and playfulness (...) have been used for top–down popularization and banalization of nuclear technologies since the 1950s, but here pleasant forms of resistance also played a central role in contesting national energy plans, expert discourses, and vested interests. This article explores what we call “anti-nuclear fun,” the use of amusement, play, and humor as political and epistemic tools to familiarize society with the exceptional and daily risks of the “peaceful atom.”. The following study departs from the lecture, entitled “Creative thinking”, delivered by Claude Shannon in 1952 at the Bell Laboratories. This paper includes an interpretive and critical account of the necessary conditions, as well as the desirable procedures, which must be satisfied in the scientific and technological invention, within the frame of the so-called scientist’s spontaneous philosophy.

Empirical research on Rational Choice Theory has brought up two focus of the economics laws problem. On one hand, we find the authors who state that the neoclassical economics laws are explanatory and predictive on specific cases: in transparent contexts in which the standard rationality operates successfully. On the other hand, we find the authors who state that the descriptive theories of the rational choice opens up a research path in which fundamental principles of the neoclassical building could be questioned. (...) Both view points have generated an important standard Rational Choice Theory revision what has produced the so called descriptive view point. It implies understanding that most of the choices take place under risky or uncertainty conditions and, that, these choices are far more complex than the normative Rational Choice Theory supposes. This article's main goal is to expand the descriptive point of view in rational choice, theorizing how some factors, coming from the social and cultural environment, operate within the rational choice. Into space of this research essay we find the debatable question of whether these sort of proposals expands the explanation of the deviation of the rational choice normative theory, and that, of the disturbing causes of the microeconomics laws, or they call into question fundamental principles of these laws and therefore they are opening the possibility to focus some economics issues in a new different manner. In 1975, the death of dictator Francisco Franco opened the door to a turbulent period known as the “Spanish Transition.” In the wake of the 1973 oil crisis, national politics, political violence and social demands were interwoven with international shifts in science and technology and global debates on “energy transitions.” In close dialogue with foreign environmental groups, the anti-nuclear movement in Spain deployed a large repertoire of collective action; it ranged from pleasant activities to violent direct actions against nuclear technologies, (...) but also included the making of technological alternatives. Counter-culture activists and counter-experts opposed nuclear energy and promoted renewable energy as two sides of the same coin. This paper explores the pioneering (and networked) initiatives of an anarchist-oriented group called Self-Managed Radical Alternative Technologies, created in 1976, and a group of young engineers who founded the cooperative Ecotècnia, which was behind the construction of the first commercial wind turbine in Catalonia in 1984. The paper focuses on the transnational circulation of grassroots knowledge, the epistemics of resistance, and the development of wind energy technologies as “technologies of protest.” Technologies of protest illuminate how the social construction of technology is intertwined with what I call the “social destruction of technology.”. A growing number of people are relying on technologies like Google Maps not only to navigate and locate themselves in cartographic space but also to search, discover and evaluate urban places. While the spatial data that underlies such technology frequently appears as a combination of Google-created maps and locational information passively collected from mobile (GPS-enabled) devices, in this article we argue that for such systems to function as both useful tools for exploration for users and sources of revenue, users must (...) actively produce massive quantities of granular spatial data that would otherwise be significantly more difficult and expensive to collect. The production of this qualitative information about places constitutes significant unremunerated affective labour. In this article, we build on the tradition of feminist geographies, especially feminist and critical Geographic Information Systems (GIS), to examine how the labour done by gendered, raced and often classed members of a local community is alienated by Google (i.e. Alphabet, Inc.) to produce commodified spatial data/media in the Local Guides platform. We analyse how Google’s presentation of the platform hails women as care labourers—sharing their thoughts, feelings and knowledge of place for free in the name of supporting and caring for a community, however vaguely it may be constituted. At the same time, we argue that digital labour that produces the Local Guides platform draws from and reproduces specific gendering of spaces. We draw on a case study of a commercial corridor in the US city of Worcester, Massachusetts to show how the dialectic between affective digital labour and urban space has material effects on the production of raced, classed and gendered spaces and places. The article concludes with a call to maintain critical, feminist engagements with these types of platforms in order to further develop forms of digital praxis towards more just cities. (shrink)

Digital services and products that expand human capabilities can help to overcome the limitations of individuals, but they facilitate the emergence of new types of inequalities. A new profile of inequality is emerging as a product of unexpected consequences of technological change and calls for institutional policy and social action measures to reduce these new inequalities. The Internet, social networking and mobile devices are helping to generate what Lee Rainie and B. W. Wellman have called a new social operating system (...) of networked individuals. I believe it is possible and necessary to define a programme of minimum requirements for living and enjoying the benefits of a digital society by reducing the risks of new types of exclusion. It is a question of advancing in the construction of citizenship with its corresponding rights in the network society. (shrink)

This article analyzes the autofigurative strategies of La travesía by Luisa Valenzuela in terms of the narratives of the self, the Argentine dictatorship and feminism. A correspondence is found between the disavowal of the voice, the structure of the autobiographical account and the portrait of the experience of the violence of the military regime and of gender. Initially, the novel is situated at the height of the narratives of the self that, with literary resources that are separated from the most (...) conservative autobiographical writings, denounce the impossibility of understanding the subject as univocal, while founding different approaches to the retelling of the experience. This location allows exploring the formal experiments that Valenzuela carries out around the autobiographical exercise and that highlight the crisis of the construction of memory and the exposure of contemporary subjectivity. In addition, it is shown how such strategies serve as a vehicle for reflection on feminism and dictatorship that permeate all of her work. For this, Valenzuela's notion of feminine writing is used, which puts the multiplicity of perspectives before the univocity of the autobiographical voice, the ambiguous before the precise, and the collective before the authoritarian. La travesía is, then, read as part of the works that come to the narration of the experience itself in a framework of the retelling of collective memory, with narrative games that point out the deictic futility of the self and the difficulty of recounting past time, without, therefore, abandoning the call for its reconstruction as a guarantee of non-repetition. It is necessary to transform the educative experiences into the classrooms so that they favor the development of intellectual abilities of children and teenagers. We must take advantage of the new opportunities that offer information technologies to organize learning environments which they favor those experiences. We considered that to arm and to program robots, of the type of LEGO Mind Storms or the so called "crickets", developed by M. Resnik from MIT, like means so that they children them and young (...) people live experiences that favor the development of their intellectual abilities, is a powerful alternative to the traditional educative systems. They are these three tasks those that require a reflective work from pedagogy and epistemology urgently. Robotics could become in the proper instrument for the development of intelligence because it works like a mirror for the intellectual processes of each individual, its abilities like epistemologist and, therefore, is useful to favor those processes in the classroom. From the analysis of Perelman by the philosopher Cristobal Holzapfel about the new rhetoric and on rhetoric itself, we can help but ask where lives the usefulness of rhetoric today. One sensible answer connects us with the sophists and the humanists’ period, for whom language was a powerful tool to change the world. Nevertheless, Holzapfel calls about the importance of rhetoric today in the construction of the world, in more or less the same way we saw in the sophists and (...) the humanists’ period. The main argument of this essay is that it makes sense to talk about rhetoric today, as Holzapfel does, because it is a medium to make a projection of the world and because it may be a good moment to propose a projection of a different world; a projection where need to have a full audience to change and take down what exists today and what we don’t like as such. Al leer el análisis del filósofo Cristóbal Holzapfel sobre la nueva retórica de Perelman y sobre la retórica en sí misma, no podemos evitar preguntarnos dónde reside la utilidad de la retórica hoy. Una respuesta sensata nos conecta con el periodo de los sofistas y el de los humanistas, en los que el lenguaje era una poderosa herramienta para cambiar el mundo. Sin embargo, Holzapfel llama la atención sobre la importancia que tiene hoy en día la retórica en la construcción de nuestro mundo, más o menos del mismo modo que vemos en los periodos de los sofistas y los humanistas. La tesis de este ensayo es que sí tiene sentido hablar hoy de retórica, como hace Holzapfel, porque es el medio para realizar una proyección de mundo y porque tal vez este sea un buen momento para proponer una proyección de un mundo diferente; una proyección para la que necesitamos contar con un auditorio nutrido para cambiar y en definitiva abatir lo que hay y lo que no nos gusta. After showing the semiotic and social nature of cultural sciences, this paper addresses the efforts to naturalize them following the so-called “Universal Darwinism”. This being settled, three initiatives of different depth and scope are analyzed. First, the proposal displayed by Mesoudi, Whiten, and Laland for the unification of the cultural sciences in parallel with the unification of biological sciences on the basis of the principles of variation, inheritance, and selection. Second, memetics as a theory of cultural selection with memes as (...) its basic units and imitation as the process of cultural transmission. Third, Hodgson’s and Knudsen’s program for an evolutionary economics brought forth by the interpretation of an abstract Darwinian ontology in terms of economic theory. The conclusion drawn is that the issue is still to a good extent open to ongoing research. (shrink)

George Rupp's Beyond Existentialism and Zen, in its typological-structural analysis and model of religious pluralism, proffers an alternative to the dominant Kantian models (e.g., by John Hicks and Sarvepalli Radhakrish nan). The question for Rupp is not which religion is true and how to decide that issue-answered in the Kantian approach in terms of an unknowable Ding an sich that all religions, albeit imperfectly, try to approximate or conceptualize (i.e., God or the Transcendent)-but rather how do religions represent, at least (...) in principle, a structural possibility for salvation or human flourishing, however different and incompatible their distinct prima facie truth claims might be. Although the potential for a radically relativistic model is implicit in Rupp's approach, it is argued here that his Hegelian assumptions lead him to accept relativism only in a provisional ("critical") way; for Rupp, under ideal epistemic conditions (e.g., the Peircian "end of inquiry"), one final conceptualization of ultimate reality will emerge as absolute truth. In the final part of this essay a version of the relativistic model implicit in Rupp's approach is defended against both the Kantian model of Hicks et al. and Rupp's Hegelian-Peircian model, which, it is argued, is incompatible certainly with the spirit of his own typological-structural analysis, if not with the letter. In challenging what Rupp calls the truth of Zen, it is further argued that not only is more than one salvific structural possibility available to us through the different world religions but also that realizing these possibilities is principally a human responsibility, and that the cosmos is quite indifferent to and compatible with several possibilities, from the most destructive to the most conducive to human well being and flourishing. The Cybersyn project has lately received increased attention. In this article, we study the local technical antecedents of Stafford Beer's Cybersyn project in Chile, particularly regarding Cybernetics and Systems ideas and local computing and networking developments. We show that the Cybersyn project in Chile was hosted by a rich intellectual environment that understood Cybernetics and Systems ideas; that it found a mature computer community and infrastructure whose high point was the State Computing Enterprise EMCO/ECOM, and an advanced networking experience whose (...) flagship was the automation of the State Bank that involved a pioneering network of teleprocess. In summary, this paper attempts to unveil the deep historical background over which the globally unique cybernetic experiment called Cybersyn flourished. (shrink)

In Nietzschean thought there is a permanent tension between culture and life; both move, many times, in contradictory directions. According to Nietzsche, culture always wins, because it has the Apollonian dimension on its part, that is, that defined, clear, refined way in which it is expressed, understands and transmits what is narrated. The beautiful form is just a way of appearing from the deeply transcendental; it is the tip of a gigantic iceberg called life. Nietzsche is a vitalist thinker, committed (...) to human expression, consisting of wanting, for love of oneself, the same thing that life wants, that is, directing its actions toward the suspension of judgments about the most convenient, most appropriate, politically correct, forms of cutural life. Childhood has an abundance of life pushing to get out--it is the Dionysian latency that does not want to succumb to the Apollonian commitment; it is life without a name, the force that devastates the encystment of form. It is life and childhood in tension, a childhood we think we know and at the same time a childhood that will never match those names we give it. Frequently the impulse for capture and closure mobilizes our adult interest, we approach childhood by naming and assigning roles, we are shaping the account we give of it. The impulse is converted into a pulse, a cadence, a recording, a ticking; Cronos appears, being acquires a permanent form, becoming gradually fades away. (shrink)

In their paper 'After-birth abortion: why should the baby live?' Alberto Giubilini and Francesca Minerva argue that because there are no significant differences between a fetus and a neonate, in that neither possess sufficiently robust mental traits to qualify as persons, a neonate may be justifiably killed for any reason that also justifies abortion. To further emphasise their view that a newly born infant is more on a par with a fetus rather than a more developed baby, Giubilini and Minerva (...) elect to call this 'after-birth abortion' rather than infanticide. In this paper, I argue that their thesis is incorrect, and that the moral permissibility of abortion does not entail the moral permissibility of 'after-birth' abortion. (shrink)

Casual sexual relationships are frequent relationship experiences in young adulthood that provide opportunities for many to explore sexual relationships and to construct their sexual identity. Empirical research on casual sex is still lacking outside North-American countries, despite evidence pointing to the need to contextualize sexual interactions in their own sociocultural context. In order to better understand casual sexual relationships, these should be examined in with novel samples in other countries where a “hookup culture” as it is described in the North-American (...) university campus is apparently absent. Through a qualitative study, we explored what casual sexual relationships consist of according to the perceptions of Portuguese college students. The thematic analysis of eight focus group interviews resulted in the generation of six themes, three of which are presented here: What CSRs are, regarding features and types of CSRs, Why individuals engage in CSRs, focusing on positive and negative motivations, and What one gets from CSRs, focusing on positive and negative outcomes of CSRs. Our findings showed that Portuguese emerging adults are familiarized with CSRs, particularly with one-night stand, friends with benefits and “curte”/hookup. Sexual interactions associated with other CSRs, such as booty call or fuck buddies, were mentioned but rarely associated with a distinctive label and established characteristics. Participants described the CSRs in a partially overlapping manner presenting some areas of ambiguity, such as with regard to sexual exclusivity and still-unlabeled sexual interactions. CSRs are generally evaluated as positively motivated and mainly beneficial. This study adds to the literature around casual sexual relationships by exploring and describing CSRs in a different sociocultural context, as well as indicating directions for future research in order to better prepare and empower young adults in their sexual and relational trajectories. On the other hand, we find the authors who state that the descriptive theories of the rational choice opens up a research path in which fundamental principles of the neoclassical building could be questioned. (...) Both view points have generated an important standard Rational Choice Theory revision what has produced the so called descriptive view point . It implies understanding that most of the choices take place under risky or uncertainty conditions and, that, these choices are far more complex than the normative Rational Choice Theory supposes. This article's main goal is to expand the descriptive point of view in rational choice, theorizing how some factors, coming from the social and cultural environment, operate within the rational choice. Into space of this research essay we find the debatable question of whether these sort of proposals expands the explanation of the deviation of the rational choice normative theory, and that, of the disturbing causes of the microeconomics laws, or they call into question fundamental principles of these laws and therefore they are opening the possibility to focus some economics issues in a new different manner. This empirical study explores the characteristics and degree of implementation of so-called ethics hotlines in transnational companies (TNCs), which allow employees to present allegations of wrongdoing and ethical dilemmas, as well as to report concerns. Ethics hotlines have not received much attention in literature; therefore, this paper aims to fill that gap. Through the analysis of conduct/ethics codes and the compliance programs of the top 150 transnational companies ranked by the United Nations Conference on Trade and Development (UNCTAD) ( 2007 (...) ), we carry out a descriptive and taxonomic study of these companies’ ethics hotlines. We analyze: (1) the basic characteristics of the mechanism, (2) the degree of exigency and the provision of safeguards, (3) the matters reported and the systems for reporting, and (4) the relationships between hotlines and economic characteristics of the firm. Our study compares financial and nonfinancial TNCs as well as North American and European TNCs. Our results show that many firms (especially from North America) have established these procedures. We also find some disparities between European and North American ethics hotlines that suggest differences in the orientation of the procedures. (shrink)

Often, vegetarians and vegans will hear the following argument from analogy in defense of carnivorism: “Animals eat each other in nature, so it's permissible for us to eat them as well”. By focusing on the (...) similarities between animals and humans, and by arguing that these similarities are indeed relevant to the issue at hand, philosopher Peter Singer presents a strong argument from analogy in favor of the conclusion that animals are indeed sentient beings. Like much in this book, the title and dust jacket illustration are clever. The first evokes Hume's remark in the Treatise that ‘Reason is, and ought only to be the slave of the passions.’ The second, which represents a cross between a dance-step and a clinch, links up with the title and anticipates an example used throughout the book to support its central claims: that Ronnie, unlike Bradley, has a reason to go to a party – namely, that there will (...) be dancing at the party – because Ronnie, unlike Bradley, loves dancing. So, the explanation of why Ronnie's and Bradley's reasons differ lies in their respective psychologies.Schroeder argues for a version of the Humean Theory of Reasons he calls Hypotheticalism, which says that every reason is explained by a desire in the same way as Ronnie's is. Schroeder argues that on almost every count, Hypotheticalism is as good as, or preferable to, the Humean and non-Humean alternatives; and he defends it against an array of objections. For example, he explains that while Hypotheticalism claims that ‘desires have to serve in the explanation of every reason because desires are part of the correct analysis of reasons’ , it does not claim that a desire that explains a reason is part of that reason: rather it is a background condition for it. According to proponents of irreducible cognitive phenomenology some cognitive states put one in phenomenal states for which no wholly sensory states suffice. One of the main approaches to defending the view that there is irreducible cognitive phenomenology is to give a phenomenal contrast argument. In this paper I distinguish three kinds of phenomenal contrast argument: what I call pure--represented by Strawson’s Jack/Jacques argument --hypothetical-- represented by Kriegel’s Zoe argument --and glossed-- first developed here. I argue that pure and hypothetical phenomenal (...) contrast arguments face significant difficulties, but that there is a sound glossed phenomenal contrast argument for irreducible cognitive phenomenology. The article addresses how societal inequalities shape market arrangements. While business scholars developed important work about the interplay of organizations and societal economic inequalities, less has been said about the embeddedness of markets in unequal social structures. We argue that this issue may be addressed by cross-fertilizing the sociological approach of Bourdieu and the Strategic Action Fields perspective. To demonstrate our view, we assessed the extreme case of polyethylene terephthalate (PET) recycling markets in Brazil, conducting a qualitative study based on (...) the precepts of abductive analysis and using data from different secondary sources, interviews, and participant observation. We verified the existence of correspondences between the power of strategic action fields and the positions the individuals controlling them occupy in what Bourdieu calls the social space and show how these differences enable inter field connections that tend to reproduce social hierarchies. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. In Steven Spielberg's A.I. Artificial Intelligence a company called Cybertronics is responsible for creating, building, and disseminating a large number of ‘mechas’ – androids built specifically to address a multitude of human needs, including the desire to have children. David, an android mecha-child, has the capacity to genuinely love on whomever he ‘imprints.’ The first of this kind of mecha, he is ultimately abandoned by his ‘mother’ Monica, and David spends the rest of the film searching for Pinocchio's Blue Fairy (...) so that he can be made into a ‘real boy’ and gain Monica's love. Their reunion finally occurs at the end of the film, after hundreds of years. Typically, the ending in A.I. is panned by critics, and written off as an egregrious example of Spielberg's sentimentalism. However, we argue that the ending is essential in order to portray a certain conception of the nature of human personhood. While many science fiction films about artificial intelligence are centered on the issue of what constitutes personhood, A.I. is one of the very few films that does not regard personhood as something purely intrinsic to the biological construction of the organism. We contend that one of the many the messages of this film is that the journey to complete personhood requires social recognition. (shrink)

In Filartiga v. Pena-Irala (1980), the Second Circuit Court of Appeals ruled that victims of human rights violations could sue their oppressors civilly in US courts under an eighteenth century law now called the Alien Tort Claims Act (ATCA). Controversy raged over the Filartiga decision and the proper interpretation of the ATCA for 24 years. Then in Sosa v. Alvarez-Machain (2004), the Supreme Court issued its first ATCA decision. This essay analyzes the effect of the Sosa decision on the development (...) of human rights law in US courts. I find that while the federal judiciary is responding to some of the Supreme Court’s directives, lower courts still retain a great deal of discretion in handling ATCA cases. (shrink)

El objetivo más inmediato de este trabajo es considerar en qué medida las críticas que desde tales posiciones realistas se han hecho a la Ética del Discurso son acertadas.

En el devenir de las artes visuales en Colombia, la preocupación por los efectos de los fenómenos de la violencia ha sido recurrente. La mirada de los artistas se ha valido de diferentes lenguajes expresivos y formas de traducción, con el interés de construir una estrecha relación entre la naturaleza de las obras y el acontecer de los propios fenómenos sociales.

De una vez anticipamos las conclusiones más importantes: 1.- En los títulos valores pagaderos con vencimientos ciertos sucesivos, el vencimiento de cada una de las cuotas debe tratarse con independencia de las demás; 2.- Por consiguiente, la prescripción de cada cuota debe ser tratada igualmente en forma independiente; 3.- No es lo mismo vencimiento que exigibilidad. Normalmente la exigibilidad coincide con el vencimiento, mas no al contrario, que el vencimiento coincida con la exigibilidad; 4.- La cláusula aceleratoria en la legislación (...) patria jamás se ha referido al vencimiento. Este ensayo analiza el principio de celeridad constitucional y su incumplimiento en la administración de justicia en la provincia del Cañar en 2022. Se analizan los tiempos de tramitación de las acciones de protección de manera exhaustiva para evaluar cómo la variabilidad y las demoras afectan la eficacia del sistema judicial. Los datos muestran que, aunque la mayoría de los casos terminan en un rango aceptable, existen significativas demoras que afectan la efectividad de la justicia. La información proporcionada por la (...) Dirección Provincial de la Judicatura del Cañar es la base de la investigación., que se analiza utilizando estadísticas como la moda, la media y la mediana de los tiempos de resolución en diferentes etapas del proceso. Finalmente, se proponen medidas para mejorar la celeridad de la administración de justicia, como establecer plazos legales máximos, optimizar los procedimientos y mejorar la capacitación y los recursos del personal judicial. The aim of the paper is to propose an alternative model to realist and non-cognitive explanations of the rule-guided use of thick ethical concepts and to examine the implications that may be drawn from this and similar cases for our general understanding of rule-following and the relation between criteria of application, truth and correctness. It addresses McDowell’s non-cognitivism critique and challenges his defence of the entanglement thesis for thick ethical concepts. Contrary to non-cognitivists, however, I propose to view the relation (...) between the two terms of the entanglement as resulting from the satisfaction of a previously applied moral function. The paper attempts to conciliate the important distinction between what-is, or exists, and what-is-not, thereby supporting Russell’s existential analysis, with some Meinongian insights. For this purpose, it surveys the varied inhabitants of the realm of ‘non-being’ and tries to clarify their diverse statuses. The position that results makes it possible to rescue them back in surprising but non-threatening form, leaving our ontology safe from contradiction.

This work presents a proposal for the characterization of the UnconfinedCompressive Strength test, through a series of operations that can be carried outwithout inconvenience in the field. Initially, fresh rock samples are obtained from outcropsin the area and specimens of specific dimensions are made. After the test specimenelaboration phase, crushing and granulometric classification tests are carried out witha set of specimens and in parallel with a second group, UCS tests are carried out. With theresults, the rock is characterized by graphing (...) granulometric curves and in this graph theareas of fine granulometry are focused, inserting in these areas, the average value of UCS,with which it can be identified and determined when it is really necessary and It is inevitableto send rock samples to laboratories, thus saving time and money for the mining project.
